1. Scope of Application
1.1 These General Terms and Conditions (GTC) apply to all orders placed by consumers
(“customers” or “you”) through the online shop of
Artur Kazun
Jaspersstr. 13
63741 Aschaffenburg
Germany
1.2 A consumer, as defined in Section 13 of the German Civil Code (BGB), is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.
1.3 Any differing or additional terms and conditions of the customer are not recognized unless we expressly agree to their applicability in writing.
2. Contractual Partner and Conclusion of Contract
2.1 Your contractual partner is Artur Kazun (hereinafter referred to as “we” or “the seller”).
2.2 The presentation of products in our online shop does not constitute a legally binding offer but an invitation to place an order.
2.3 By clicking the “Order” or similar checkout button, you submit a binding offer to conclude a purchase contract regarding the items in your shopping cart.
2.4 Immediately after sending your order, you will receive an automated order confirmation by email. This confirmation merely documents that we have received your order; it does not constitute acceptance of the offer.
2.5 The contract is only formed when we expressly accept your offer (e.g., by email confirmation) or by dispatching the goods.
3. Prices and Payment
3.1 All prices are stated in euros and include German value-added tax (VAT) at the current statutory rate of 19%.
3.2 Shipping costs are not included in the product prices and will be displayed separately during the order process. The customer bears these costs unless otherwise agreed (e.g., free shipping promotions).
3.3 The following payment methods are available:
- Bank Transfer (Prepayment)
- PayPal
- Credit Card
- Direct Debit
- Klarna (if offered)
Payment is due immediately upon conclusion of the contract, unless otherwise specified.
4. Shipping and Delivery
4.1 Delivery is made to the address specified by you when placing the order.
4.2 The usual delivery time within Germany is about 3–5 working days (unless stated otherwise). If the item is on pre-order or produced on demand, the delivery time may be extended by approximately one additional week.
4.3 Shipping costs:
- Germany: €4.50
- EU countries (except Spain and Denmark): €12.90
- Spain and Denmark: €14.50
- Switzerland: €18.90
- Other destinations (e.g., UK, USA, Canada): See checkout or inquire with us
For deliveries to non-EU countries (e.g., Switzerland, USA, Canada), additional duties or import taxes may apply, which must be borne by the customer.
5. Retention of Title
The goods remain our property until full payment has been received.
6. Right of Withdrawal
6.1 Consumers (as per Section 13 of the German Civil Code) have a statutory right of withdrawal for 14 days. Details and required information are provided in our separate Withdrawal Policy.
6.2 In the event of a withdrawal, you bear the direct return shipping costs, unless otherwise specified.
7. Warranty and Liability
7.1 Statutory warranty rights apply.
7.2 We accept unlimited liability for damages resulting from intentional or grossly negligent breaches of duty. For cases of simple negligence, we are liable only for the breach of essential contractual obligations (cardinal duties) that enable the proper execution of the contract and on whose compliance the customer regularly relies. In such cases, liability is limited to foreseeable damages typical of such contracts. No further liability is accepted.
7.3 The above limitations of liability also apply for the benefit of our legal representatives and vicarious agents. Statutory warranty rights remain unaffected.
8. Online Dispute Resolution and Consumer Dispute Settlement
8.1 The European Commission provides a platform for Online Dispute Resolution (ODR), available at https://ec.europa.eu/consumers/odr/
8.2 We are neither obliged nor willing to participate in any dispute resolution proceedings before a consumer arbitration board.
9. Data Protection
Please see our separate Privacy Policy for information on the processing of personal data and data protection on our website.
10. Applicable Law and Language of the Contract
10.1 All legal transactions are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only insofar as no mandatory statutory provisions of the state in which the consumer has his or her habitual residence are limited or overridden.
10.2 The language of the contract is German. Any English version of these terms is provided for convenience only.
11. Final Provisions
Should any provision of these GTC be deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect. Instead of the invalid or unenforceable provision, the relevant statutory provisions shall apply.
